The U.S. Supreme Court recently ruled that all married couples in California
– including same‑sex couples – must be treated by the federal
government as married persons, with equal rights and respect.
The Supreme Court struck down an important aspect of the Defense of Marriage
Act (DOMA), which had required that the federal government treat same‑sex
couples as unmarried and prohibited the federal government from granting
any of the federal benefits, protections, responsibilities based upon
marriage to same‑sex married couples.
Through this ruling, a same‑sex married couple can now take advantage of
the commonly identified federal benefits associated with the right to
marry including, but not limited to, rights to a spouse's Social Security,
survivor and retirement benefits, income and estate tax benefits (e.g.,
married and filing jointly within a couple's income tax returns),
veteran's benefits available to spouses and immigration benefits.
